1. Beta Service Overview
Funding Yield OS ("FYOS", "we", "us", or "our") currently operates as an open beta analytical platform for evaluating funding and yield opportunities in crypto derivatives markets.
These Terms of Use govern your access to and use of the FYOS beta. By accessing or using FYOS, you agree to these Terms. If you do not agree, do not use the service.
FYOS is an informational and analytical product. It is not a brokerage, exchange, custodian, execution venue, portfolio manager, or fiduciary.
2. Open Beta Nature of the Service
FYOS is not yet a final commercial release. The beta may change materially, including its features, availability, interfaces, calculations, limits, access policies, and documentation.
- Beta features may be added, changed, limited, suspended, or removed at any time
- Access may be modified, throttled, or revoked at our discretion
- We do not guarantee uninterrupted availability, continuity, or feature stability
- Some outputs may be bounded, contextual, coverage-limited, or experimental
3. Eligibility and Accounts
You may use FYOS only if you can form a binding agreement under applicable law and are permitted to use the service in your jurisdiction.
Beta access currently follows an authenticated open-beta model. That means normal use does not require an active paid subscription, but it does require an account and compliance with these Terms.
You are responsible for maintaining the confidentiality of your credentials, API keys, sessions, and any other account access artifacts. You must notify us promptly of any suspected unauthorized use.
4. Product Semantics and No Reliance
FYOS provides clean-core analytical outputs such as opportunity attractiveness scoring, deployability signals, deterministic decay analysis, observed-risk fields, bounded planner recommendations, and scenario-only simulator outputs.
- `edge_value_score_v2` is an attractiveness score, not a deployability guarantee
- Deployability depends on structural constraints such as `edge_capacity_24h` and other limits
- Planner outputs are bounded recommendations, not execution commitments
- Simulator outputs are scenario analyses, not validated forecasts or promises
- Reality and trust surfaces provide evidence and context, not guarantees
You must exercise independent judgment. FYOS should not be used as the sole basis for trading, investment, treasury, legal, tax, or operational decisions.
5. No Investment Advice and No Execution Services
FYOS does not provide investment advice, trading advice, legal advice, tax advice, brokerage services, custody, discretionary management, or execution services.
We do not recommend that you enter, size, hold, unwind, or avoid any trade. Nothing in FYOS should be interpreted as a guarantee of profitability, future returns, or suitability for your objectives.
6. Bounded Data and Coverage Limitations
FYOS depends on exchange data, historical coverage, modeled interpretations, and empirical linkage that may be incomplete, delayed, stale, limited by source constraints, or unavailable for certain exchanges, symbols, horizons, or market regimes.
- Not all opportunities are covered equally
- Some signals are explicitly bounded or contextual rather than universal
- Coverage grades may differ across rows and segments
- Availability of raw market data or realized linkage may change without notice
7. Deprecated and Non-Authoritative Branches
Deprecated or non-authoritative branches, such as survivability-led primary semantics and `soft_capacity_usd` as a primary capacity truth, are not part of the current trusted beta contract.
If legacy or diagnostic fields remain visible anywhere, they must not be treated as canonical product truth.
8. Acceptable Use
You may not:
- abuse, disrupt, reverse engineer, or attempt to compromise the service
- scrape or automate access in violation of stated limits or applicable law
- misrepresent FYOS outputs as guaranteed, fiduciary, or execution-ready instructions
- resell, sublicense, or redistribute access without authorization
- use FYOS to violate exchange rules, sanctions, or applicable regulations
9. Beta Access and Commercial Terms
Normal beta access is not the same as a final commercial subscription. Public paid conversion paths may be disabled during beta, and future commercial plans may change before any paid launch.
Unless we expressly present a separate written commercial agreement, nothing in the beta should be read as a promise of final pricing, final packaging, subscription continuity, or commercial service levels.
10. Third-Party Services and Market Sources
FYOS may reference or interact with third-party services, market data providers, exchanges, cloud providers, authentication tools, and infrastructure vendors. We are not responsible for the uptime, accuracy, continuity, or policies of those third parties.
11. Intellectual Property
FYOS, including its software, interfaces, methodology summaries, documentation, designs, branding, and analytical outputs as presented by us, remains our property or that of our licensors.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the beta for your internal evaluation and lawful internal business purposes.
12. Disclaimers and No Warranty
FYOS is provided on an "as is" and "as available" basis during beta, without warranties of any kind, whether express or implied.
We disclaim, to the maximum extent permitted by law, warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, continuity, and availability.
13. Limitation of Liability
To the maximum extent permitted by law, FYOS and its affiliates, officers, employees, and contractors will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including trading losses, lost profits, loss of opportunity, data loss, business interruption, or losses arising from reliance on analytical outputs.
If liability cannot be excluded, our aggregate liability arising out of or relating to the beta service will be limited to the greater of one hundred U.S. dollars (USD 100) or the amount you paid us, if any, for access to the beta in the twelve months preceding the claim.
14. Suspension and Termination
We may suspend, limit, or terminate access to FYOS at any time, with or without notice, including for security reasons, abuse prevention, legal compliance, product changes, or beta program changes.
15. Changes to These Terms
We may update these Terms from time to time. Updated Terms become effective when posted unless a later effective date is stated. Your continued use of FYOS after the update means you accept the revised Terms.
16. Governing Law and Disputes
These Terms are governed by applicable law as determined by our principal operating jurisdiction, excluding conflict-of-law rules. Any dispute arising out of these Terms or your use of FYOS will be resolved in the forum and manner specified by applicable law and any mandatory consumer protections that apply.
